Selling inherited property in Israel: a guide for overseas heirs

The buyer sees one apartment; the heirs must also resolve the estate. Before accepting a deposit or signing, connect the Israeli probate order to title, identify every authorised signatory, review the property and calculate tax and closing logistics.

An Israeli death certificate or foreign grant alone does not transfer an apartment. The sale needs a usable Israeli succession or probate order, a registrable title chain and authority from every person whose rights are being sold.

Overseas heirs should also design powers of attorney, authentication, tax reporting, originals and banking arrangements before booking a notarial appointment abroad.

1. Establish who can sell

Start with a final Israeli succession or probate order and match the heirs and shares to the registered owner. Then identify where title is held: the Land Registry, Israel Land Authority or a housing company. Each system has its own inheritance and sale documents.

Registering the inheritance first can make the title chain clearer, but it is not a universal sequence. Counsel should confirm how the inheritance and sale filings will connect before promising a closing or registration date.

2. Align co-heirs before marketing becomes a contract

Where several heirs own shares, identify who is selling, who signs, where the proceeds go and how expenses are allocated. One heir cannot usually bind the entire property. A power of attorney or estate administrator only works within the authority actually granted.

If the underlying order is disputed, review the route for objecting to an Israeli probate or inheritance order before the transaction advances.

3. Conduct ordinary property due diligence as well

Obtain a current title or rights certificate and check mortgages, attachments, cautions and third-party rights. Review possession, tenancy, planning, building irregularities, municipal exposure and any urban-renewal agreement.

A probate order confirms succession; it does not cure a property defect. The sale contract should allocate the steps, documents, taxes, mortgage releases and conditions required for clean registration.

4. Calculate Israeli tax before setting net proceeds

An inherited-residence exemption is not automatic. Section 49B(5) requires three cumulative elements: the seller must be the deceased's spouse, descendant or spouse of a descendant; before death the deceased owned only one residential apartment; and the deceased would have qualified for an exemption if selling while alive.

Review acquisition history, previous transactions, use, expenses and each seller's facts before signing. As a general rule, the transaction is declared within 30 days. The Tax Authority paper dated 19 March 2026 also examines inherited apartments in urban-renewal projects, but its special conclusions are expressly confined to that context.

5. Design the overseas execution and closing route

Prepare a transaction-specific power of attorney before the appointment abroad. Confirm who authenticates the signature, whether an Apostille or consular process is required, how names match the passport and Israeli order, and whether originals must be couriered.

Must the inheritance be registered before the sale?

Prior registration often clarifies title and can simplify closing, but the correct sequence depends on the registry, the Israeli order and transaction structure. Confirm the registrable chain before signing.

Can one heir sell the whole apartment?

Generally not without authority from all relevant rights holders. Review signatures, transaction-specific powers of attorney and any estate administrator's appointment and court-approval limits.

Is an inherited apartment automatically exempt from Israeli capital gains tax?

No. Section 49B(5) contains cumulative conditions concerning the seller's relationship to the deceased, the deceased's apartment holdings and the exemption the deceased would have had. Individual tax review is essential.

Can an overseas heir complete the sale remotely?

Often many steps can be handled remotely under a properly drafted power of attorney, but authentication, Apostille or consular requirements, originals, identity checks and banking arrangements must be planned in advance.

When is the Israeli real-estate tax declaration due?

As a general rule, the seller and buyer declare the transaction within 30 days. The form, calculation and exemption application depend on the transaction and current law.
