Israeli severance pay and Section 14: what is covered and what may still be due?

A contract reference to ‘Section 14’ does not settle the final account. The result depends on the governing arrangement, the percentage deposited, the insured salary, uncovered periods and the reason employment ended.

This issue is especially easy to miss when an international business employs staff in Israel or an employee cannot readily read the Hebrew pension records. The legal label, payroll line and actual pension transfer must tell the same story.

A month-by-month reconciliation before termination is usually safer than trying to reconstruct years of deposits after a dispute begins.

1. Identify the legal source and effective date

Section 14 allows qualifying employer payments into a pension or insurance fund to replace severance liability for the salary and period covered. The arrangement may arise from a collective agreement, extension order or a personal agreement satisfying the general approval.

Check the signed annex, its effective date, the salary base and the fund named. A generic clause cannot cure missing deposits or automatically cover earlier years.

2. Reconcile 6% and 8.33% deposits

A 6% severance component may replace only part of the statutory liability, leaving a top-up when the employee is entitled to severance. An 8.33% contribution may provide full coverage, but only for the salary and months properly included under a valid arrangement.

Common gaps include a late pension start, deposits calculated on a lower insured salary, variable pay omitted from the base and interruption when the employee changed funds.

3. Separate the accumulated fund from an employer top-up

At termination, ask two questions: what happens to money already accumulated in the pension fund, and whether the employer owes anything further. Dismissal in qualifying circumstances may trigger a top-up. Resignation does not automatically create the same additional entitlement, even where accumulated deposits remain allocated to the employee.

Fund withdrawal has pension and tax consequences. Technical availability is not the same as a recommendation to withdraw.

4. Build a defensible final calculation

List each salary period, insured salary, deposit percentage, missing month and current fund balance. Compare the legal and contractual liability against actual transfers—not simply the employer's payroll instructions.

For an employer-led termination, coordinate the figures with a proper pre-dismissal hearing, notice and final documentation. Special protections may apply, including the permit regime for dismissal during pregnancy.

5. International employers should not copy a foreign template

An Israeli annex must align with Israeli pension reporting and the applicable extension orders. A global contract describing a generic severance benefit may not address the local fund, salary base or waiver language.

Retroactive approval is exceptional. The Ministry of Labor requires a reasoned application and supporting employee, payroll and accounting material.

Not necessarily to the full severance entitlement. The mandatory pension order, personal or collective agreement, deposit rate, insured salary and commencement date all need to be reviewed.

The ordinary starting point is the date of the signed arrangement. The Ministry of Labor provides an exceptional application route for retroactive approval with specific conditions and supporting documents.

What should an overseas employer or employee collect?

The signed employment agreement and Section 14 annex, payslips, pension deposit reports, a current fund statement and termination documents. Hebrew records should be reconciled by month rather than summarized from one balance.
